I filed Chapter 13 which was confirmed and discharged. Once the plan was confirmed, my attorney had me record the plan under the property with the recorder’s office. The plan states that the property is to be surrendered back to the mortgage companies. The special terms state that the debtor is surrendering the real estate property to both lender’s in full satisfaction of its secured claim. Pursuant to 11 U.S.C. 1322 (b) (9) legal title to the aforementioned property shall vest in both lender’s (named in plan) upon confirmation of the Debtor’s Chapter 13 plan. The lender of the first mortgage discharged me from the loan and the lender who holds the second mortgage says that i still own the property. Who legally owns the property.
