I wanted to know if one can always depart the U.S. to go back to one’s birth country. I have two class D felony warrants. I left last year to my country with the warrants active. I recently just got back from a year away last September. I have a green card but it’s damaged.
I was admitted to the U.S. and didn’t get arrested by Homeland Security or Customs. The officer just shook his head and allowed me to enter. A lawyer I spoke to recently told me that I could leave but it would be different on the way back this time. I wouldn’t get so lucky and would get arrested at immigration.
My question is can I depart? I think I should be good because I was able to leave before. If it makes a difference, I will travel with an airline from my country. Do I just show my passport when I leave? What about my damaged green card?
By the way in one of my posts I was told there is no exit checks and CBP doesn’t inspect departing passengers. I would only deal with it at re-entry.
